A fresh blow for TiVo (NSDQ: TIVO) in its ongoing patent battle with Dish and EchoStar (NSDQ: SATS). The United States Patent and Trademark Office has rejected TiVo’s claims to two patents the companies are battling over in federal appeals court. A federal court had ruled in TiVo’s favor in March — but the victory was short-lived when the appeals court agreed to rehear the case last May.
In a statement, TiVo says it’s “disappointed” but also says the decision “does not impact the current United States Court of Appeals en banc review.” In their own statement, Dish and EchoStar counter that the “software claims are the same claims that EchoStar was found to have infringed in the contempt ruling now pending for en banc review.”
This fight dates back to 2004.
