This is in response to the post whether there are adequate safegaurds against misuse of cyber-identities in blogs (Indiatimes article). According to Probir Roy, a reader, there are enough.

I disagree with Pavan – while there is no specific law under the prevailing IT laws, there is adequate coverage under IPC to ward of such attacks. The liability for comments by one blogger against another does not immunize or preclude Indiatimes against liability of ‘electronic distribution” of material it knew it had reason to believe was malicious. This can be covered under Artilcle 21 which covers privacy as also IPC 509, Section 425.
I would bring to your notice that Barrett Vs Rosenthal S122953 being currently heard in the Californian Supreme Court in appeal of an appelate court ruling that “the law does not grant immunity to someone who publishes defamatory material froma third party” – I would assume that a blogger indentity on Indiatimes can be mapped to an id and therefore individual entity.
