I think this is a bit of fear mongering going on: it is a bit too early to get worried about piracy of rich content through mobiles. Anyway, SMS.ac has already started lobbying in Washington DC as the debate shapes up, according to this story. SMS.ac is a mobile SMS and MMS community.
“If fair use [of digital media] continues to be a gray area,” says Greg Wilfahrt, co-founder and executive VPof SMS.ac, “then the mobile phone content space will become wholly litigious.”
Rep. Rick Boucher (D-Va.), has proposed the Digital Media Consumers’ Rights Act, said: “This will become much more current [as mobile data swapping] gets more common,” Boucher warned. He doesn’t think it’s fair use for audience members to send a video clip from a paid concert to someone else’s mobile phone. “A strict interpretation of the law is once you purchase a concert ticket you accept all terms and conditions related to redistribution,” he says.
