Microsoft is asking a judge to move the antitrust suit filed against it by RealNetworks to federal court in Seattle, alleging that RealNetworks chose San Jose, Calif., as the venue because it believed it would get a more favorable jury there.
But RealNetworks disputed that assertion, saying that it chose to file in San Jose solely because it wants to present a jury with as many live witnesses as possible during trial, rather than showing videotaped depositions or reading from transcripts. The greatest number of potential witnesses in the case live in Silicon Valley, according to the company.
