		<description><![CDATA[&lt;p&gt;Interesting read.  I agree that the legal risks increase with the amount of recognition the machinima receives.   The advice about partnerships with the game makers and using creative commons and license free audio is excellent.  As my work is posted on more sites with 3rd party advertisers and other commerce related activity, I am even more careful about my content and that everything has been approved by content creators before publishing.&lt;/p&gt;

But in its essence fair use can be boiled down to whether the work you are creating infringes on the ability of the creator whose work you are using to make money AND if the work you are creating is transformative -- i.e. did you create something new and original, even if it incorporated the work of another?
