Leopard uses far more open source software than Vista does but the overall operating system is licensed to consumers for use only on Apple hardware.

If you join the Apple developer program you are licensed to use Mac OS X on other hardware for "testing purposes". For example to setup several different versions of OS X on VMWare to facilitate testing your applications on different versions of OS X. Or perhaps on an OQO 2 to test your applications for the rumored soon-to-be released Apple UMPC/PDA. :-)
