Never have they had a non-compete clause included though.

I traditionally offer a confidentiality agreement as part of my new client sign-on process. I think it helps folks feel comfortable providing me the level of access I sometimes need to work with them.

In some cases, these clauses can severely limit a freelancer’s ability to work in a particular market, and for several years.

As a copywriter, I’ve refused to sign several NDAs with non-competes – absent a much bigger fee to compensate me for the potential revenue loss.

The clients – when confronted by that reality – were more than happy to excise the offending passage.
