Google, Facebook, Adobe, Vobile and more than 30 other companies are the defendants in this same patent “infringement” case… It’s the unfortunate side effect of the patent law and legal system in this country.

Vobile is garbage. Until they can honor fair use, no site should use them. Also, why would Ustream have to contact a “vendor” to cancel them? I think Vobile is grasping for straws..

It’s a common practice for video sites to maintain and operate a whitelist of users or channels who have cleared their copyrights. So it seems the issue was the user who used Ustream to broadcast the Hugo Award should have informed Ustream before the show that they had the clearance from the copyright owners, so Ustream could put it in the whitelist so that this unfortunate incident would never happen.

I hope Ustream doesn’t give up on fair use altogether. That’s certainly the easiest road to take, but ultimately will back fire on any service that doesn’t respect that element of copyright.
