I don't think I said laws, in general, are obsolete, just certain laws when applied to the web. Copyright laws can work just fine within the framework of the web, I think, once we get past some of the issues around curation, aggregation, etc. But my Netflix history (something, by the way, I wouldn't share on Facebook if I were an active user) isn't copyrightable, so I'm not sure I make the connection. Laws about data privacy, on the other hand, are different because there are cultural and technological shifts toward more -- and willing -- sharing of personal information.

Not that I'm disagreeing with the assertion that laws need to be more targeted to the way the web evolves, but I'd like to point out that there are some very real web-favoring differences created by current laws, such as the CDA and DMCA.

What I think is more pressing for our lawmakers and regulators is how to keep the web free and open in a world where large corporations are desperately trying to control how you and I access and use it.

Derrick – I liked the article but was wondering if you could comment on this…if laws don’t matter (and/or are obsolete for today’s time) , then would you support the removal of this from the Gigaom terms and conditions?

The GigaOM Site is proprietary to GigaOM and is protected by intellectual property laws and international intellectual property treaties. The entire contents of GigaOM Site (the “Content”) are copyrighted as a collective work under the laws of United States and other copyright laws.

Personally, I support laws that protect content – both personal and business. I could care less that others want that information and cry when they cannot know everything about me including what netflix movie i just viewed.

Brett,

I'm all for regulation and privacy laws, but the hard part is doing them right for the web, which is a constantly evolving but ethereal beast. The problem with every law I noted is that they were written for specific technologies or business models decades ago, and it's either very difficult or stifling to try and apply them to the web. I think a great challenge for lawmakers will be to write laws for the web that somehow reflect what it is and is not and that regulate it appropriately.
