Oh yea, I love it when the Apple cult tries to keep it's ground. Remember, Apple is cool, and hip. Oh, and don't forget greedy, big corporate America no different than the pharmasucials and big agriculture. You would think Jobs had learned something from that health scare, maybe theres karma and he and his company should be a little more humane. There's plenty of money out there, and I'm sure he and his lawyers have all the houses, cars, crap, etc they would ever need or be able to use. Then again, if you have the mentality to let your daughter live in poverty while your making money, your capable of anything.

But Apple was granted the patents and lawyers eat "vague and generic" for lunch.

You're making a mistake that many are making: that the lawsuit is about the validity of the patents. It's not. It's about whether or not HTC violated patents that Apple was legally granted. On the surface HTC appears to have done so.

HTC, Microsoft, or Google could chose to separately challenge the validity of the patents. However, there's a good reason they might not. Doing so could put their "vague and generic" patents under scrunity.

The real problem here is the current patent and copyright system.

Requested specific information from command and control, control freak Apple is like pulling teeth- oh yeah, it's that back-breaking. Also, there are those Nokia's suits against Apple. I hope Apple gets wiped out from the face of the earth.

THis is why, as the commercial goes, I am a PC. Apple is a bully, an exclusionary and classist bully. Back in my college days, to get a computer it was either a $3,500+ mac or a much cheaper pc. Then to upgrade a mac you had to buy all new software, whereas the pc was backward compatible.
I agree Apple needs to come off their high horse and let some of the little people access their products without having to join their "exclusive" club. I'm just saying. Go Google!!! Kick butt, just as Microsoft did before.

Ok, in my opinion, regardless of whether or not Jobs has a case, I think that any loss in sales could have been easily thwarted by offering the iphone on other carriers such as sprint and verizon. Seriously! That's his own fault for signing whatever contract he signed to prevent cell phone users living in areas where the coverage is dominated by other carriers. Why would I buy an iphone if A: I'm currently under contract with another company, or B: I won't be able to get signal at my house and/or place of work?

The key word here is "nuisance," as in nuisance suit. Apple has sued in the past over intellectual proper rights even when in fact Apple was neither the inventor or patent holder. Capacitive touch screens gestures is a good example.

So why HTC?

Well, when you hit someone with a nuisance suit you want a target small enough without the financial resources or patience to put up with a potentially long and costly litigation but large enough that any concessions gained to be consider significant precedents in future court proceedings. In Apple's eyes, HTC fit the profile.

So what about Google and Microsoft?

Obviously Apple felt that Google and Microsoft were to big to go after directly and felt that HTC was a weakness. I believe at some level Google and Microsoft see the Apple suit as a threat and have probably adopted a wait-and-see strategy. If the case goes badly for HTC, Google and Microsoft could petition the court to join the case in some matter and make their considerable resources available to HTC. Obviously neither Google or Apple want HTC to make any concessions to Apple or a court decision favorable to Apple.

Of course, what Apple is doing is playing the game. Given that the U.S. Patent office will grant a patent to any wacky idea scrawled on the back of a used Kleenex, copyright law has been so screwed up to accommodate a certain mouse in Florida, and there's absolute no financial consequence for losing a nuisance suit, who cam blame Apple for pursuing a strategy that at the surface appears to be in long term interests of its shareholders.

Yes, Apple is effectively losing out on a lot of potential market share. For the first time in years it's no longer sitting on the Easy Train. It seems that having to respond to serious market competition has become unfamiliar to the company. This swashbuckling lawsuit reaction just proves that Jobs no longer knows how to actually participate in a truly competitive market. No longer sitting pretty on the high horse in unquestioned authority has got him in a state of major PMS.

You have a valid point but I think right now, it is MS people should watch. In the Apple v.s. Google case, MS might decide to side with Apple since Apple is not really a threatening competitor to MS(Compared to Google). Remembering the roumors few weeks ago that Apple might consider Bing instead of Google and ATT putting Yahoo on its Android phone, the plot might get ticken soon. Also MS is said to be behind the EU vs Google antitrust issue.
