		<description>&lt;p&gt;Having worked for both companies, I can tell you that Level 3 will never catch Akamai simply b/c it cannot execute and deliver.   Their systems are extremely hard to use for their own employees let alone a customer.  In addition, they&#039;ll never get the technical leadership within major accounts that Akamai has and will continue to have.&lt;/p&gt;

&lt;p&gt;Patents are mostly worthless pieces of paper, and very few that I have read contain anything novel, and certainly not the secret to protecting a company&#039;s moat.&lt;/p&gt;

&lt;p&gt;IBM as well as many other companies are forced into this patent game because everyone else is playing.  The truth is, the people in the patent office are idiots and regularly give patents that would not hold in court.  Patent law basically boils down to a pissing contest, and the pissing is done by lawyers who are payed millions of dollars despite never accomplishing anything of technical value themselves.&lt;/p&gt;

&lt;p&gt;These lawyers, and the broken (I won&#039;t say corrupt, since corrupt implies somebody is actually competent enough to plan the horrible results we have now) patent system which keeps them employed are the real problem.
