The industry needs to move past guidelines if we are going to solve this issue. To move this effort forward, publishers need contextual, web-wide visibility of where their content is appearing. This information will enable them to post their distribution policies or rules of use – in effect creating a community based marketplace for online content.

A showdown is coming, and unless the courts overrule the previous idea of fair use a more open internet will be the result.
